This web page with referred documents states our term and conditions on which you can find information about our partners restaurants and their meals list on our website for you (customers). Before ordering any meals from our website, please read carefully our term and conditions. You agreed to follow our term and conditions and bound by our terms of use policy. In case of any question before place an order please contact us at support@ambereat.co.uk. If you are not agreed on our term and conditions you have the right not to use our Services.

Ambereat.co.uk is UK based website registered in England and Wales, registration number 11056289 office located at 105 London Street Suite 86 Reading Berkshire RG1 4QD. 


Resolution

Ambereat is a UK based web portal that provide service to Restaurants to display their menus and allow online customer to select and order meals from our partner Restaurant on our website.  We act as an agent on behalf of our partner Restaurants. Once customer have placed an order through our website for partner restaurant’s page, your ordered meal delivered to you by Ambereast’s rider. Customer can make a call to partner restaurant to order a meal and partner restaurant take that order by using our Point of sale service which is available on Ambereat’s restaurant app. 


Service Obtainability

To become our partner restaurants, after registration restaurant become our partner restaurant to offer meals to online customer though https://ambereat.co.uk. Our service available in Reading, Berkshire area and in the UK. Each City has its own City Admin and divide the city into different regions according to partner restaurants locality, so that each partner restaurant has a prescribed delivery area to offer their meals to online customers. This feature help online customers to get meal at their door step through Amber riders. If customer reside outside the deliver area, an instant message appears on screen to alert customer that this service from partner restaurant will not available until customer provide delivery address in the designated area for partner restaurant, otherwise online ordering will not be possible. It is the customer liability to provide right delivery address, our service will not accept order from customers those post code fall in outside designated area for partner restaurant. Working hours will differ on local trading conditions and depends upon availability of partner restaurants. By using our service, customer click on appropriate link to view the available menus, after selecting the menu, customer can select different items and submit the order from our partner restaurant.    


Placing an order 

After select menu from Partner restaurant, you place an online order though our mobile app or website’s service, the request send to the partner restaurant to approve the order and confirm their acceptance. Partner restaurant select the delivery time, at that time, you will get the confirmation email on behalf of the partner restaurant, which include thank you message and the confirmation about in receipt of your order and accepted by the partner restaurant.  The confirmation email is the contact for the supply of your order meal through us between Partner Restaurant after getting the confirmation email from us.  Please make sure you have provided the exact email address and contact number, because this is the only mode of communication between us for your order. As well, make sure you provide an accurate delivery address, so the Amber rider deliver your meal at the right address. After physically arrival of the Amber rider at the provided location, if you do not open the door or not responding to telephone or text message from amber rider within 10 minutes, the rider has the right to leave your locations, and the charged payment for the ordered meal will not refund.  

To make sure about the quality of our service, we regularly monitor our partner restaurants to make the food quality and temperature for your ordered meals. In case of any complain and comments about Delivery or Meals, you can contact us my calling us or contact us by email.  


Allergy Alert and Meals

If you have any allergy, please contact our partner restaurant before ordering any meal. Partner restaurants might use nuts in the preparation of their meal. Ambereat cannot give assurance about meals sold by our partner restaurant are free of allergens. All offered meals by Partner restaurant are subject to availability.


Sale of Alcohol

By placing an order that includes Alcohol from our partner restaurant will not be entertained until unless you agree to deliver it without Alcohol. 


Meal Delivery and Service availability 

Ambereat endeavor to ensure the best delivery service to our Customers. All orders are delivered by an Amber rider/authorized person of Amber eat. Ambereat and the Partner Restaurant will give their best efforts to deliver the order within the specified time. Neither Ambereat nor the Partner Restaurant will be liable for any costs, loss or damage suffered due to late delivery of orders. If the Goods are not delivered within the time specified by us, then please contact our customer service. Deliver fees will not be repaid, if an order does not arrive on time. At the time of handover to the recipient, all risks in relation to the Goods are passed to the recipient. If you are not able to receive the order at the time of delivery, we will not be able to deliver the order at another specified time and will not provide any refunds. You should make the necessary precautions to ensure easy and safe Delivery of the Goods. We exclude all liability for damage and / or costs of the Goods ordered, if it is the result of negligence on your part to provide and / or to make adequate precautions for the Delivery. Although we shall endeavor to ensure:

  • that the order will be delivered to the specified address
  • within the specified time;
  • inform you in case the order is expected not to be delivered within the specified time.

Please note that it is not possible for Ambereat to deliver in all districts. If this is the case, Ambereat will contact you and we will ensure that your order is cancelled or delivered to another address.


Availability and Delivery

Our aim is to ensure you get the best delivery service possible. Unfortunately, things do not always go to plan and factors, such as traffic conditions and weather, may occasionally prevent us, or our Restaurant Partners from achieving our targets in this regard. We will do our best to ensure that your meal is delivered by the time specified in the email and web page. The timing of your order is determined by taking into account the number of orders and the circumstances being faced by the Partner Restaurant at that time.


Order cancellation

You have the right to cancel an order within a reasonable time and before any Restaurant Partner has used food to start preparing the order (a "Started Order"). Customers can cancel an order by contacting the Partner Restaurant. Ambereat and the Partner Restaurant may cancel any order and will tell you once we cancel an order. You will not be charged for any orders cancelled in accordance with this clause. Any payment made prior to an order being cancelled by Ambereat or a Partner Restaurant will usually be reimbursed using the same method you used to pay for your order. Any order cancelled after it becomes a Started Order will be charged to you. Ambereat alone will determine whether an order is a Started Order or not.


Price and Payment

The price of any Meals will be listed on our Service. Prices include VAT. Prices will vary between menus. Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation Email, save in the case of an obvious pricing mistake, whereby we will notify you as soon as we can about the pricing issue. You may be able to cancel your order once we notify you. Despite our best efforts, some of the Meals listed on our Service may be incorrectly priced. The relevant Partner Restaurant will normally verify prices as part of the order process. Payment for all Meals can be made by credit or debit card through our Service. Once your order has been confirmed your credit or debit card will have been authorized and the amount marked for payment. Payment is made directly to Ambereat acting as agent on behalf of the Partner Restaurant only. We are authorized by our Partner Restaurants to accept payment on their behalf and payment of the price of any Meals to us will discharge your obligations to pay such price to the Partner Restaurant. In limited instances, where you have selected a Partner Restaurant that offers Partner Delivery, you can also make your payment in cash directly to the Partner Restaurant by paying the Partner Delivery driver at the time of delivery. Where cash payment is possible, this will be made clear on our Service before you place your order.

Where Ambereat or any Partner Restaurants make a delivery, we may at our sole discretion charge you a delivery fee which will be notified to you before you complete your order.


Tips for riders

When you place an order, you will have the option to make a discretionary payment in the form of a tip or gratuity to Ambereat in addition to the purchase price of the Meals in your order. Additional information on how Ambereat deals with tips is available on our website.


Ambereat Liability

To the extent permitted by law, Ambereat provides our Service and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of our Service, or that it will be timely or error-free or that defects will be corrected. Subject as provided below, neither Ambereat nor any Partner Restaurant shall have any liability to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our Service. In the event that Ambereat or the Partner Restaurant is found to be liable to you our total aggregate liability is limited to the purchase price of the Meals you have paid for in your order. This does not exclude or limit in any way Ambereast’s or any Partner Restaurant's liability for any matter for which it would be illegal for us or it to exclude, or attempt to exclude, our or its liability, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.


Events Outside Our Control

No party shall be liable to the other for any delay or non-performance of its obligations under these terms arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion. For the avoidance of doubt, nothing in this clause 12 shall excuse the Customer from any payment obligations under these terms.


No Agency

Nothing in these terms is intended to constitute Ambereat as your agent or authorize Ambereat to enter into any commitments for or on your behalf.


Waiver and severability 

Neither you, Ambereat nor the Partner Restaurant shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.

If any provision of these terms is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.


Entire Agreement and changes in these Terms and Conditions

These terms contain the whole agreement between the parties relating to its subject matter and supersede all prior agreements, arrangements and understandings between the parties relating to that subject matter.

Ambereat may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.


Law and Jurisdiction

The English courts will have jurisdiction over any claim arising from, or related to, any use of our Services. These terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

Some of the information collected will not personally identify you but will instead track your use of the Website so that we can better understand how the Website is used by customers and in turn enhance and improve your experience in ordering food. We may obtain this information by use of cookies. Cookies are a small data file transferred to your device that recognises and identifies your device and allows your device to 'remember' information from the Website for future use. Cookies do not contain any information that personally identifies you and we do not use cookies in order to obtain such information - your personal information can only be obtained by Ambereat if you actively provide it to us. We may collect technical information from your mobile device or your use of our services through a mobile device, for example, location data and certain characteristics of, and performance data about your device, carrier/operating system including device and connection type, IP address, mobile payment methods, interaction with other retail technology such as use of NFC Tags, QR Codes or use of mobile vouchers. Ambereat will use all reasonable endeavours to maintain the security of your personal information and to protect your personal information from misuse, interference and loss and against unauthorised access, modification or disclosure. Ambereat will destroy any personal information it holds about you which it no longer requires under the terms of this Privacy Policy. Where you have chosen a password to access certain services of the Website, you are responsible for keeping your password confidential. We recommend not sharing your password with anyone. Due to the nature of the internet, Ambereat does not provide any guarantee or warranty regarding the security of your personal information during transmission to us or storage by us and you acknowledge that you disclose your personal information to us at your own risk. Please contact us immediately if you become aware or have reason to believe there has been any unauthorised use of your personal information in connection with the Website.  


How will we use the information we collect from you?

You consent to ambereat collecting and using your personal information for processing and delivering the order/s placed on the Website and any other service provided through the Website. In particular you expressly consent that ambereat may disclose your personal information, including your name, email address, physical address and telephone number to riders delivering your order, either employed by ambereat or by third parties providing delivery services to ambereat. You consent to ambereat using your personal information for advertising and direct marketing purposes in order to inform you about the Website and the goods and services it provides, or other matters that it believes will be of interest to you. ambereat may disclose your personal information, and you consent to the disclosure of your personal information, to:

  • other entities within the ambereat group of companies; and
  • third parties engaged by ambereat or other members of the ambereat group to perform functions or provide products and services on our behalf such as processing payments, mail outs, debt collection, research, statistical information, marketing and direct or indirect advertising.

If you would like to unsubscribe from receiving direct marketing communications from ambereat or do not want us to share your personal information with other parties, please e-mail us at support@ambereat.co.uk follow the steps to unsubscribe which are presented in every communication you receive from us, requesting your personal information be removed from our mailing list. We will use reasonable endeavours to comply with your request within a reasonable period of receipt of your request. Please note that the withdrawal of any authorisations for processing of your personal information by third parties may result in us not being able to provide you with any services. ambereat reserves the right to disclose your personal information if it is required or authorised to do so by law, or, if it is reasonably necessary in its opinion to protect the rights or property of ambereat or any third party, or to avoid injury to any person. If the ambereat business is sold or merges with another entity then some or all of your personal information may be passed to a third party.  


Access to your information  

ambereat will use all reasonable endeavours to keep personal information it holds accurate, complete, up-to-date, relevant and not misleading. Please contact us if you would like to access the personal information ambereat holds about you. We will use reasonable endeavours to provide a complete list of your personal information within a reasonable period of receipt of your request. Please email us if you would like to receive a copy of this information – support@ambereat.co.uk.  Ambereat reserves the right to charge a nominal fee for the processing of this request in accordance with local legislation. You may contact us to correct any of your personal information that is inaccurate, incomplete or out-of-date, or to request that your personal information be deleted. We will use reasonable endeavours to correct or delete your personal information as requested within a reasonable period of receipt of your request. Deletion of your account with ambereat will not automatically delete the personal information held about you. If you would like ambereat to delete all personal information together with the deletion of your account, please follow the steps mentioned-above. Please note that the deletion of your personal information from our database will result in us not being able to provide you with any services. If applicable, any legal requirement on us to maintain certain records of your personal information shall prevail over any of your requests. We may require you to prove your identity before providing you with copies of your personal information
